This week we have a comment from an esteemed local Attorney who commented on President Trump’s Executive order on cashless bail. Like many of Trump’s Executive orders, they are issued without the consequences they would have on nonviolent cases.

  

ON CASHLESS BAIL

Trump signs an executive order today to end cashless bail and will attempt to put pressure on states that permit cashless bail by denying federal funding to those states. What people don’t realize are the following as examples: A homeless veteran commits a low level misdemeanor on federal property and has no prior record. He will be arrested and jailed even though ultimately eligible for a pretrial diversion, a short period of probation and dismissal of charges.   A 21 year old college kid gets pulled over for a DUI-first offense and no injuries. He will be lodged in jail under Trump though the state would permit cashless bail and ultimate pretrial diversion, including probation, counseling etc followed by dismissal of charges

The consequences of eliminating cashless bail will have devastating affect on the poor and those who made a minor mistake. States and counties will not have enough prisons to lodge such low level offenders. It will turn the court system into an authoritarian tool and turn back treatment courts that are servicing the needs of those with mental health/drug addiction problems who commit minor offenses.

Another step to turn away from democracy to an autocratic dictatorship.  Wake up MAGA you created this nightmare and now this type of action can affect your family or you one day. You are not immune.
