OBAMA'S CHOICE

President Barack Obama on Monday nominated Solicitor General Elena Kagan to the Supreme Court, declaring she would demonstrate the same independence, integrity and passion for the law exhibited by retiring Justice John Paul Stevens. There seems to be a big outcry on the right about the fact that Kagan is not a sitting Judge. Many are saying that someone political should not have that job. Well folks we need balance on the court. We have it in terms of religion, gender and race. There is no longer a "Catholic", "Jewish" or "Black" seat on the court doled out like a quota. But now we need to turn back a little and put someone on the court who is familiar with the process (the nominee was a clerk for Thurgood Marshall) but someone who has a sense of the world. Two former Chief Justices, Fred Vinson and Earl Warren were elected officials. Vinson was a Kentucky Congressman who served as Treasury Secretary under President Harry Truman before being elevated as the Chief. Warren was Governor of California who ran for Vice President in 1948 with Thomas Dewey. Potter Stewart was the former Mayor of Cincinnati before being appointed by Ike. Byron “Whizzer” White was a former football star appointed by John Kennedy to the Supreme Court. He served as
United States Deputy Attorney General, the number two man in the Justice Department under Robert F. Kennedy. He took the lead in protecting the Freedom Riders in 1961, negotiating with Alabama Governor John Malcolm Patterson the man who preceded George Wallace in that office. My point here is that there is precedence for this type of appointment. The shift toward scholarly justices started in the 1970s when Richard Nixon began getting his Southern nominees rejected by the Democrats in the Senate. Most Presidents fearing a battle royal erred on the side of caution appointing appellate and Federal judges that had a body of work. I think the addition of Kagan to the court is going to give it the political balance it needs on social issues. And for my Republican friends who fear this new Court will be legislating, let us not forget that activist court in 2000 that gave the election to President Bush by a ruling over the duly elected President Al Gore.

BACK AGAIN

Mayor Cassandra Coleman will be hosting the 2nd Annual Joseph F. Coyne III Softball Tournament Sunday, May 16, 2010 beginning at 9am, at the Exeter Little League Field. Last year the group was able to raise over $5,000 for a family whose daughter was battling brain cancer. This year, they are raising money for a senior at Wyoming Area who was diagnosed with MS, and since has developed lesions on her brain and spine. Last year there were 12 teams who battled it out. There will be special events going on all day geared towards the children. Appearances will be made by TUX, from the WBS Penguins, CHAMP from the WBS Yankees, and Pat Ward, renowned clown. There will also be face painting between 10am-2pm. So if anyone is interested in entering a team, get please contract Mayor Coleman ASAP @ 654-3001 ext 5. Also, anyone who is interested in donating food, drinks, money, prizes, or their time, the day of the event please get contact Mayor Coleman.

ARNONE RESIGNS

Russ Arnone quit as Jenkins Township Supervisor. I met Arnone when he worked in the Courthouse and thought he was a straight shooter. At one time he was head of Property and Supply under the Trini and Phillips administration. My fellow political observer Joe Valenti reported this breaking news on his web site PittstonPolitics. Com. One of my sources tells me this might have to do with Luzerne County’s favorite builder and developer throwing Russ to the federal wolves. MA SHE'S MAKING.........

A University of Valencia reveals that just being around a beautiful female can cause men to release cortisol, a nasty stress hormone. Cortisol is produced during physical or psychological
stress and can contribute to worsening heart disease, diabetes, erectile dysfunction, clinical depression and hypertension. In the study, 84 men attempted to solve a sudoku puzzle with a woman they considered "out of their league" in the room. When each man was left alone with the gorgeous lady, his cortisol levels spiked. Researchers believe that the hormone increase had to do with the opportunity for courtship.When it comes to relationships and courtship, excitement and fear are two emotions that frequently go hand in hand. But the good news is, by using some specific techniques, cortisol release can be kept at bay. Study officials say that when men stop seeing women solely as sex objects, they'll have an easier time keeping anxiety in check.Yeah that’ll happen.

Once more you make a very compelling case for more people on the court who have real world experience. The debate over men vs woman on WILK was ridiculous today. Webster had it right, you pick the person, not because of gender but by what they know and what their life experience is. Potter Stewart, White, and those you mentioned were very good judges with experience grounded in real life. Nice job pointing that out.

Nancy Kman today showed she has is a bigot. It is okay for her to say that men and women view things differently so the court should be made up of either. However, she downplayed the black experience, the latino experience, the homosexual experience as not being on the same level as gender.

This choice for the Highest Court is OK with me. The woman was the head of the law department at Harvard ...... If she doesn't have the proper judicial mind and credentials then who the hell does? She can have a pizza in my shop anytime and she gets her choice of toppings.

I DID NOT GET THAT FROM LISTENING TO HER. I DON'T SEE HER OR HEAR HER AS A BIGOT, I THINK SHE IS CHAMPIONING THE CAUSE OF WOMEN. AND IN SOME CASES THAT MAY SOUND AS TOO MUCH ADVOCACY FOR SOME AT THE EXPENSE OF OTHERS BUT BIGOT IS TOO STRONG A WORD.

If not bigoted then Ms. Kman is closed minded.
the simple fact is the supreme court is NOT a representative body. However, with that said; to state that gender trumps all in deciding who is to serve is pattently uninformed. The black experience is much more profound and subjucated than any in American history. Can you imagine that people think of you as a criminial at first glance. That people walk across the street if they see you coming down one side of the street?
Nancy Kman is a lilly white person who lives in a lilly white community sheltered from the real world of racism and discrimnation.
I understand her opinion and respect her stance, but she disrespects people of color who have had injustice.
It would be nice if we could just get the best person period. However, Ms Kman and her ilk don't believe in the best PERSON they believe in quotas.

Imagine if the linked case, or one similar, somehow made its way to the Supreme Court. Would suburbanite, privileged, white woman Nancy Kman understand the implications of being black in America?
Would she understand the plight of black Americans?
No, she wouldn't. To claim that the highest court in the land should be gender balanced without consideration for any other factors is in fact, bigoted. You don't have to have anger in your heart to be bigoted. You must have ignorance in your mind to be so. To claim that your "minority" is more important than all others is bigotry.
I am a woman of mixed background and having been the victim of bigotry in my life, I can spot it a mile away.
I know you won't publish this, I aware that you are more about protecting WILKers than free speech, but this time put your own interest aside and expose the hypocrisy of WILK. You don't need them.

Women are actually the majority. I absolutely believe there should be more of Black America represented on the Court. How about a black woman?

All this talk about WILK reminds me of how much I miss the acerbic wit of Kevin Lynn. He wouldn't let colleagues or callers get away with fuzzy thinking. And they hated it.

I can't wait to hear tomorrow's beer buzz Friday, to witness the Rock 107-ing of what used to be the Morning News. Don't get me wrong - I don't hate Webster, in fact, I like the guy. But his pairing with Nancy produces a bland morning show. Will a beer buzz help? We'll see.

Have to disagree 11:25. Kevin often used fuzzy thinking and fudged facts. As far as bland, the morning show is now not only more interesting, but more entertaining. Now if they dump the Mr. Negativity Corbett maybe I will listen past noon.

Ms. Kman, women get minority status in this country.
Women get preference for placement, government grants and loans based on gender. So while statistically not a minority, they are given minority status.

With that said. I don't care about gender nor race when it comes to the court. The court is not a representative body, it is the ultimate arbiter and I am more concerned with education, experience and temperament than gender, race, ethnic background, religion or any other litmus test. I care about the President nominating whom he thinks is most in line with his ideology. That is why I voted for President Obama, because of his ideology, not his race, not his gender, not even those big big ears.
