My 15 year Facebook account has bee  hacked and pretty much lost to history. We are in the process of rebuilding it so if you get a friend request from me, this time it’s real. 

 

SUPREME COURT TAKES IMMUNITY CASE

I’d like to know why exactly the not so Supreme Court is hearing the case as to whether a President deserves immunity from prosecution of any crime, including murder while he is in or out of office.

The Appellate Court gave the high court an air tight well thought out judgment. The court doesn’t need to verify that UNLESS there is an ulterior motive.

AND YES, I DON’T TRUST THIS SUPREME COURT!

A big flag for me is hearing this in late April, The Court ruled in a few weeks about Trump staying on the ballot, they ruled on Bush V Gore in a month and during the Nixon investigation in a matter of a few weeks.

This court has lost all credibility with the American people as the Republican majority seems to bend over backwards to accommodate Trump and therefore destroy American democracy.

They are a well paid joke that makes a mockery out of a court, as well as any lawyer who stood for the bar.

 

McCONNELL STEPPING DOWN

McConnell’s departure leaves the Senate, and the Republican Party itself, at an uncertain crossroads, days before the Super Tuesday presidential primary elections when Trump is expected to sweep up more states in his march to the Republican Party nomination.

Trump’s ascent proved to be an almost untenable political situation for McConnell — the two men have not spoken since December 2020, when McConnell declared that Biden had legally won that year’s election. McConnell lashed out at the defeated president after the Jan. 6, 2021, attack on the Capitol, calling Trump “morally responsible” for the bloody siege. He has not yet endorsed Trump for president in 2024.

But McConnell made this craziness all possible. In 2016 he refused to hold a Senate confirmation on Merritt  Garland who became Joe Biden’s feckless and ineffective Attorney General dragging his feet on the January 6^th investigations. He then voted no on Trump’s second impeachment which would have disqualified Trump from even running.

He might be regarded as the lonest serving Leader in the Senate but he was the most partisan, wily and anti democratic one. The issue with McConnell leaving, (who was bad enough) are the number of isolationist mean spirited Trumpanzees that will be even worse than old Miitch. (Washington Post, LuLac)

 

DIVISION IN THE RANKS OF GOP COUNTY PARTIES

It appears that Luzene County is not immune from the splintering of their once prosperous and sensible party and may have fallen victim to the Trump vitrus that has infected America. We understand that there are three segments going for the brass ring for leadership. The current hroiup which has been a traditional force and has grown the party within striking distance of catching up to the Dems in \registration. Then the Harry Haas wing of the party who think they can do better and then the Trumpanzee wing of the party which is taking the name of the GOP and confusing p;eople as to which party this is. 

The Republican party (t traditional)  had the engines running smoothly to be the majority party. In 2021 they nabbed two Judges and 5 seats on County Council, What is there to fix? By the crazies embracing  four times indicted, unbalanced person is not going to help anyone in 24.

Let me remind readers that in 2022  there was supposed to be a big red wave coming as predicted by Alyssa Fusaro o who violated all kind of protocols by speaking like this while being a member of the non p;artisan Luzerne County election board.

The red wave went nowhere in 2022 and no one needs to be reminded of these facts:

1.  The GOP has only won one popular vote election in 8 Presidential elections. 2. By trying to screw with drop b 006Fres and mail., in balloting on the county level they are hju\rting their own Alyssa Fusaro.

HUNTER BIDEN IN DEFIANT DEPOSITION BLASTS GOP, INSISTS HE DID NOT INVOLVE HIS FATHER IN BUSINESS

Hunter Biden was defiant Wednesday in a closed-door deposition on Capitol Hill, blasting a Republican impeachment inquiry into his father and the family's business affairs as a “house of cards” built on “lies” as he faced a battery of probing questions from lawmakers.

“For more than a year, your Committees have hunted me in your partisan political pursuit of my dad,” Hunter Biden said in an opening statement obtained by The Associated Press. He accused Republicans of trafficking in "innuendo, distortion, and sensationalism” and insisted, "I did not involve my father in my business.”

After the nearly seven-hour deposition wrapped, an attorney for the president's son told reporters that during the testimony Republicans "produced no evidence that would do anything to support the notion that there was any financial transactions that involved Hunter with his father. Period."

Yet after conducting dozens of interviews and obtaining more than 100,000 pages of documents, Republicans have yet to produce direct evidence of misconduct by the president. Meanwhile, an FBI informant who alleged a bribery scheme involving the Bidens — a claim Republicans had cited repeatedly to justify their probe — is facing charges from federal prosecutors who accuse him of fabricating the story.

This isd amazing. The GOP Congress has not passed immigration reform and border protection when it was handed to them on a sliver platter. They have become enablers of Putin, AKIN TO Nazi sympathizers before World War II in not giving Ukraine aid as well as Israel. Then there’s the government shutdown threatsa. This investigation is a SHAM and any right minded voters in 2024 hould give the House back to the Democrats while the baby GOP crybabies, manna bees poop in their pants and then throw shit at the American people trying to disguise it as an ice cream Sunday. SCRANTON POLICE DETECTIVE KYLE GILMARTIN WILL BE CARTWRIGHT’S GUEST AT STATE OF THE UNION

, U.S. Congressman Matt Cartwright (PA-08) announced that Scranton Police Detective Kyle Gilmartin will be his guest at the 2024 State of the Union Address on March 7 in Washington, D.C.

Detective Gilmartin is currently recovering in a rehab facility near Philadelphia after being seriously injured when he and fellow officers were ambushed in a gang-related shooting in January.

“Detective Gilmartin and the fellow officers who saved his life represent the uncommon valor demonstrated by our nation’s law enforcement officers who put their lives on the line every day to protect our communities,” Congressman Cartwright said.

“I am greatly honored to be able to attend the State of the Union as Congressman Cartwright’s guest,” Detective Gilmartin said. “The invitation is a testament to his longstanding support of law enforcement and public safety. Congressman Cartwright checked in on me daily since I was shot and nearly killed. My family thanks the City of Scranton and the community for the outpouring of support they have provided us. We can never thank everyone enough. We love our community and its leaders.”

Rep. Cartwright visited the detective and his wife, Lindsay, at the Philadelphia rehab facility on Feb. 22 to personally ask him to attend the President’s address.

A Luzerne County native, Gilmartin graduated from Holy Redeemer High School in 2008 and the Lackawanna College Police Academy in 2010. A nine-year veteran of the Scranton Police Department and a former police officer in Duryea, Old Forge, Ashley and Wilkes-Barre and Pittston townships, Gilmartin was shot twice in the head after tracking down reports of prior shootings in the city that night.

“This is the story of the courage, strength and grit of this one man, and of the generosity and humanity of the people of our area, in recognition of and gratitude for his service and sacrifice,” Cartwright added.  “As Kyle was fighting for his life, so many of us were calling and visiting with him and his family; so many of us were holding and attending fundraisers for him; so many of us were praying for him, for Lindsay, and for their whole family. Thanks to that support, and a long roster of heroic medical and rehabilitative professionals, he survived the shooting and has been making remarkable, amazing progress. It’s a story that I am proud to display before the nation by inviting Detective Gilmartin as my honored guest for this year’s State of the Union address.”

In case you missed it, today, the New York Times featured an investigation by U.S. Senator Bob Casey (D-PA), Chairman of the Senate Health, Education, Labor, and Pensions (HELP) Subcommittee on Children & Families, on shrinkflation. Casey has been taking big corporations to task for price gouging, causing the excessive increase in prices American families are facing. His recent series of reports show working families across our Nation are paying higher prices due to greedflation, when big corporations use economic turmoil as cover to raise prices beyond the rate of inflation, and shrinkflation, which occurs when big corporations reduce product size without lowering prices accordingly or notifying consumers.

Senator Casey has been spearheading congressional efforts to hold big corporations accountable for prioritizing their profits over the American people. In December 2023, Senator Casey released his shrinkflation report detailing how big corporations are making record profits by reducing the size of household consumer goods. In January 2024, he urged the Government Accountability Office, an independent watchdog, to investigate the effects of corporate greed on American consumers. In February 2024, Casey introduced legislation to protect American families from greedflation by banning grossly excessive price increases and crack down on corporate price gouging.

New York Times: Biden Targets a New Economic Villain: Shrinkflation

Mr. Biden could also embrace new legislation seeking to empower the Federal Trade Commission to more aggressively investigate and punish corporate price gouging, including in grocery stories.

White House officials credit Senator Bob Casey, Democrat of Pennsylvania, with bending the president’s ear on the issue. Mr. Casey’s office released a scathing shrinkflation report last year calculating that about one-tenth of recent price increases for snacks and toilet paper were attributable to companies’ reducing the number of cookies in a bag or sheets on a roll.

Mr. Casey has centered the issue in his re-election campaign, blaming large companies for price increases that have left consumers struggling to afford sufficient amounts of essential items. “Some of this is really pernicious,” he said in an interview. “You can’t wait a year to buy paper towels or to buy boneless chicken or to buy groceries or to buy Huggies diapers.”

I was getting undressed from work and heard  the often tiring and moronic Angelo from Madisonville. i had no idea that Ang there was a medical expert. He opined on bow feeble Biden was and needed to be retired. This is a President who has HANDLED everything THAT HAS BEEN THROWN AT HIM.  The two then got into the cognitive ability of this President when there was nary a word about their Lord and Savior Donald Trump. Biden can cite statistics of an issue WHEN  all Trump can do is bullshit and and lie. Angelo says maybe we should  let Biden retire., How about this-let Angelo retire from  making his stupid remarks and opinions when he barely backs it up with facts.

The 1984 New Hampshire Democratic presidential primary was held on February 28, 1984, in New Hampshire as one of the Democratic Party's statewide nomination contests ahead of the 1984 United States presidential election.

Candidates had to receive a minimum of 16.6% to receive delegates. The primary selected 12 delegates, who then selected the remaining 8 delegates on April 15. George Bruno and Holly Abrams, the chair and vice-chair of the New Hampshire Democratic Party, were superdelegates.

The contest schedule created by the Democratic National Committee placed the New Hampshire primary on March 6, the same day as the non-binding Vermont primary. However, New Hampshire moved its primary to February 28, in violation of these rules, in accordance with a state law that required it to be held at least one week before any other state's primary.  Iowa also violated the rules when it moved its caucus to February 20, in order to be eight days before the New Hampshire primary.

Jeanne Shaheen, who managed Jimmy Carter's primary campaign in New Hampshire in 1976 and 1980, managed Hart's campaign with her husband as co-chair.

 51% of voters determined who they were supporting before the Iowa caucus. 31% of these voters supported Mondale, 29% supported Hart, 11% supported Glenn, and 9% supported Jackson. 14% of voters determined who they were supporting the week before the primary, 12% the weekend before, and 8% the day before. Hart won over 57% of these voters. Hart won 44% of the 15% of voters who selected who they supported on the day of the election.

41% of Jackson voters listed Hart as their second candidate in exit polls conducted by CBS News and The New York Times'.

Hart won a plurality of the popular vote. Reubin Askew, Alan Cranston, and Fritz Hollings ended their campaigns after their poor results in the primary.

Hart and Mondale both won 6 delegates in the primary, receiving three delegates from both congressional districts. Hart mathematically received 3.449 delegates in the 1st district and 3.414 delegates in the 2nd district while Mondale received 2.55 and 2.58 delegates in each district.[1] Both candidates had 9 delegates when the remaining were selected on April 15, and 4 delegates were uncommitted. Mary Chambers was selected as chair of the delegation….and the number one song in Lulac land and America was “That’s All” by Genesis.

The situation in the Middle East still rolls on. To put it all in historical perspective ius an observation   from writer and scholar Peter Gagiliardi.

 To understand the current conflict in the Middle East we must understand President Carter's foreign policy.  President Carter's foreign policy is often described by the phrase "The hell of good intentions."  President Carter had the best of intentions for peace in the Middle East, and yet today we are dealing with the hell of his failure. 

President Carter wanted to convene a grand peace conference in Geneva to solve all the problems of the Middle East including the Palestinian Issue and the future of the Gaza Strip and the West Bank. He could not convene the Geneva Conference, and we would up with a limited bilateral peace treaty between Israel and Egypt.  Today we have the hell of brutal war in the Gaza Strip and the war threatens to escalate out of control. President Carter demonstrated great wisdom in calling for a Geneva Peace Conference and a comprehensive peace agreement in the Middle East.  Unfortunately, he could not get international cooperation and the peace conference could not be convened.  This paper will review the reasons why the peace conference in Geneva could not be convened.

 THE STEPS TO PEACE

I Love Great Books as they enlighten me and this is where I get my greatest insights.    This is an article about the greatest book I have ever read about the miracle at Camp David, and the fine art of peacemaking.  The book is entitled Thirteen Days, Carter, Begin, and Sadat at Camp David by Lawrence Wright.  I have a Master's Degree in Government and Politics and I learned more about diplomacy and peacemaking from this book than I did in all my years as a student.  You can have the same success by reading great books at the library.

1.  Peace Is Always Possible

When President Carter came into office, the consensus at the time was that peace between Israel and her Arab neighbors was impossible.  President Carter was the only known major leader in his generation who believed real peace was possible and he pursued it with great vigor and determination as he believed God Himself wanted him to bring peace to the Middle East.

Wright's book displays the principles of diplomacy and peacemaking that can be used to peacefully resolve any conflict.  These principles can also be used to resolve the conflicts in your life.  Here are the universal principles of diplomacy and peacemaking:

2.  Chose a Peaceful Environment

President Carter chose Camp David as it is isolated, peaceful, close to nature, and would encourage people to leave their grudges behind.

=3.  Be Willing To Make Sacrifices For Peace

Carter, Begin, and Sadat were willing to pay the price for peace.  President Carter risked his presidency.  President Sadat gave up Egypt's traditional role as leader of the Arab world as the peace treaty was widely opposed in the Arab world.  Prime Minister Begin put Israel's security on the line as he gave up the entire Sinai Peninsula, a strategically important piece of real estate, to make peace with Egypt.

 

4.  Know the People Involved in the Conflict

 

President Carter studied and understood President Sadat and Prime Minister Begin and that made it possible to negotiate the peace treaty. President Carter studied a thick briefing book that the government compiled.  Carter's understanding of Prime Minister Begin made peace with Israel possible. The Camp David conference was beginning to conclude on the thirteenth day and there was no final agreement as Prime Minister Begin was holding out.  President Carter knew that his grandchildren meant the world to him, and he used this to his advantage.  President Carter had a batch of photographs for the three leaders to sign, and they were to be souvenirs for Begin's grandchildren.  Carter signed each photograph with the inscription "with love" and wrote the name of each grandchild on the photos.  Begin was sitting on the porch in great anguish because the negotiations had failed.  When Carter approached him Begin simply wanted to dismiss Carter.  Carter handed Begin the photos and he noticed that he had signed the top photograph with the child's name on it.  For example, the signing read "To Ayelet."  Begin was moved by Carter's display of human kindness and compassion and he froze as he read the names of the grandchildren on the photos.  One by one he read the children's names and Begin began to cry.  Begin invited Carter into the cabin and suddenly Begin was friendly.   Begin changed his mind and accepted the agreement.

 

5.  Be Flexible

President Carter wanted a comprehensive peace treaty.  When this proved impossible, Carter lessened his goal to a separate peace between Israel and Egypt.

 

6.  Know Your Proper Role

Frequently, a peacemaker can be successful simply by being a facilitator or mediator. This is not always possible, and then the peacemaker must play a larger role and become a catalyst.  This requires the peacemaker to get personally involved in the conflict and present specific proposals to resolve the issues. Begin and Sadat could not make any progress by talking to each other, so President Carter had to play a much larger role.  President Carter became a catalyst for peace and began presenting specific proposals to solve the issues.  President Carter used the one-text procedure which is based on a simple concept.  As the catalyst, President Carter wrote the basic document or peace treaty and then asked each side for their response.  Issues that are not contested are considered agreed upon.  Those that are contested are then dealt with by continually narrowing  the differences.  When each side finally agrees on an issue, that issue is considered complete.  The key is that as the catalyst, President Carter controlled the document.  When the contenting parties hit a stalemate and could not agree, President Carter proposed new ideas and new language.  Issues that would lead to war and economic ruin in the Middle East were resolved.

7.  Be Persistent

It took thirteen arduous days to negotiate this agreement, and there were plenty of opportunities to give up.  Carter pursued peace until he finally had an agreement.

TRUMP: DEAD LAST

The annual Presidential Greatness Project Expert Survey was conducted from Nov. 15 and Dec. 31 of last year, and included the responses of 525 historians and political science scholars. Experts were again in agreement that Abraham Lincoln should top the list, with Presidents Franklin D. Roosevelt, George Washington, Theodore "Teddy" Roosevelt, and Thomas Jefferson rounding out the top five.

One thing distancing Trump from the rest of the pack was the issue over his ability to unite those with opposing viewpoints. Respondents ranked him the most polarizing president in U.S. history, ahead of Presidents Andrew Jackson, Barack Obama, and Ronald Reagan.

The ranking of Biden in the number 14 slot is a contradiction of his poll numbers suggesting that Americans want to trade Biden for a flawed last place individual.

One thing that pleasantly surprised me was that three Presidents who were vilified at the end of their terms, Truman and Johnson placed in the top ten along with Dwight Eisenhower who was regarded as a steady but boring presence.

GOP MAJORITY ARE HOSTAGE TAKERS OF UKRAINE FIGHT FOR SURVIVAL

The Republican party in Congress has become the lapdog of Putin in Russia. They are holding hostage aid to Ukraine. It is true that Russia has now made advances because aid to the country, a Democratic country invaded by a suppression-oriented government ran out of ammunition. The responsibility of this backslide does not belong to the Ukrainian fighters but to the Republican Congress.

They are enablers of Putin.

They  will be responsible if Ukraine falls.

They will be held accountable if Poland is invaded.

This Republican Congress should be recognized for what it is:  a collaborator of a  foreign dictator hellbent on the destruction of democracy.(CNN, LuLac)

 

GOP CONGRESSIONAL LEADERS HEADING FOR THE DOOR

 

As the 118th Congress has been dominated by deep dysfunction and bitter divisions inside the GOP, a number of Republicans – particularly from the so-called governing wing – are heading for the exits. So far, 23 GOP lawmakers have decided to not seek reelection or resigned early, including five committee chairs, though some have cited personal reasons or are seeking higher office.

Still, the caliber and timing of some of the retirements has raised alarm bells, particularly those who are giving up coveted committee gavels that some work their whole career to achieve.

Energy and Commerce Chair Cathy McMorris Rodgers of Washington is not even term-limited yet in her plum post, while China select committee Chair Mike Gallagher of Wisconsin, a 39-year-old who was once seen as the future of the party, recently announced he was leaving Congress after facing intense blowback for voting against impeaching Homeland Security Secretary Alejandro Mayorkas.

The GOP majority of 5 is shrinking mainly because serious legislators see the folly of doing nothing. Trumped up impeachment charges, the spreading of blatant lies and the interactions with the Trump acolytes have made the role of a Congress person not as attractive as it used to be.

At times, the GOP infighting has been so nasty it has almost led to physical blows. And lately, Republicans can’t even seem to pass basic procedural votes, known as a rule.

“It is very dysfunctional right now,” said Rep. Brian Fitzpatrick of Pennsylvania, co-chair of the bipartisan Problem Solvers Caucus. “You have tight margins and divided chambers, and you have a Rules Committee that’s been very dysfunctional.”

Underneath the chaos, there is also growing anxiety about the chances of the House GOP holding on to the majority in November, which was further compounded by Republicans losing a special election in New York – a key battleground – last week.

CARTWRIGHT CO-LEADS BIPARTISAN LEGISLATION TO MONITOR TOXIC MERCURY POLLUTION IN THE U.S.

U.S. Representatives Matt Cartwright (D-PA-08), Brian Fitzpatrick (R-PA-01) and Brian Mast (R-FL-21) introduced the Comprehensive National Mercury Monitoring Act in the 118th Congress. This bipartisan bill would establish a national monitoring program to provide researchers with better data on the extent of mercury contamination in the U.S., helping to inform where to target pollution reduction initiatives.

Mercury is toxic to humans, even in small amounts. It has adverse effects on both children and adults, and it can impair the brain development of a child in utero, leading to birth defects.

“Protecting children from harmful toxins is a no-brainer, and I’m proud to introduce this bill with both Democratic and Republican support,” said Congressman Cartwright. “Mercury pollution is a serious environmental and public health concern, but right now, we don’t have strong enough data to tackle it. With a national monitoring program, we can take more informed actions to protect Americans from exposure to this toxic element.”

“We must receive more data on mercury poisoning in order to protect all Americans from these harsh toxins,” said Congressman Fitzpatrick. “That is why I’m proud to support this bipartisan bill to establish a national comprehensive monitoring program that will provide researchers with accurate data on the extent of mercury contamination in the United States.”

“More than half of fish and wildlife in the Everglades system are affected by toxic mercury and people in Florida are at some of the highest risk in the whole country for mercury poisoning. Infants and unborn children are particularly vulnerable,” said Congressman Mast. “But, despite the gravity of the issue, our country doesn’t have a comprehensive mercury monitoring network, and as a result, polluters get off without consequence. This bipartisan bill would mandate that monitoring so we can fight this toxic assault at the source.”

Summary of the Comprehensive National Mercury Monitoring Act:

National Mercury Monitoring Program — directs EPA to establish a national mercury monitoring program to measure and monitor mercury levels in the air, water and soil, and in aquatic and terrestrial life.   

Mercury Monitoring Advisory Committee — directs EPA to establish a scientific Advisory Committee to guide the development and operations of the national mercury monitoring program.

Multiple Monitoring Sites — directs EPA to select multiple monitoring sites representing multiple ecoregions of the U.S.

Data Collection and Distribution — directs EPA to create a centralized database of environmental mercury data that can be freely accessed on the Internet.

This is a companion bill to one introduced in the U.S. Senate by Senators Susan Collins (R-ME) and Tom Carper (D-DE). It is supported by the American Lung Association (ALA) and the League of Conservation Voters (LCV).

“Mercury is a powerful neurotoxin that is detrimental to health," said Harold Wimmer, President and CEO of the American Lung Association. "Mercury is of particular concern to infant health as it can lead to developmental birth defects and interfere with neurological development, even from exposure while in the womb. Combined with efforts to reduce air toxics emissions at the Environmental Protection Agency, which we hope to see finalized very soon, this legislation will improve health outcomes for some of the most vulnerable populations."

CASEY, COLLEAGUES URGE BIDEN ADMINISTRATION TO UPDATE TAX CREDIT GUIDANCE TO SUPPORT DOMESTIC CRITICAL MINERAL SUPPLY CHAIN

IN LETTER, SENATORS CALL ON ADMINISTRATION TO INCENTIVIZE INVESTMENT IN ENTIRETY OF US CLEAN ENERGY SUPPLY CHAIN, INCLUDING KEY PENNSYLVANIA INDUSTRIES

U.S. Senator Bob Casey (D-PA) joined a letter with seven of his colleagues to Treasury Secretary Janet Yellen urging the Biden Administration to allow critical mineral mining and processing activities to qualify for tax credits they passed in the Inflation Reduction Act.

In the letter, the Senators urge the administration to ensure that raw materials and extraction costs are eligible for the 45X Advanced Manufacturing Production Tax Credit. The Department’s initial proposal to implement the credit explicitly excludes these costs, which sharply reduces the value of the tax credit. This update would allow the tax credit to support the entirety of the clean energy supply chain, including innovative critical mineral recovery that is happening in Pennsylvania and across the U.S.

“Congress passed the Inflation Reduction Act in part to support the domestic extraction and production of critical minerals and materials,” wrote the Senators. “The clear purpose of section 45X was to encourage investment in the United States and to build a reliable and resilient domestic supply chain for critical minerals right here at home. The section 45X credit was designed to support responsible domestic mining and processing of these minerals…However, by excluding the majority of the production costs from the 45X credit, Treasury would disincentivize investment in the United States, and also increase our reliance on countries that do not share our democratic or geopolitical values.”

Senator Casey has long fought to ensure Pennsylvania’s industries are included in the development of a clean energy supply chain. In 2023, he secured $2.1 million for research at Pennsylvania State University into the process of recovering critical minerals from acid mine drainage. He also secured $10 million to support Pittsburgh-area clean energy manufacturing, and additional $500,000 to establish an economic hub for the green building supply chain in Southeastern Pennsylvania.

Dear Secretary Yellen,

We are writing in response to the notice of proposed rulemaking for the Section 45X Advanced Manufacturing Production Tax Credit. We request that the U.S. Department of the Treasury (Treasury) make revisions to the proposed rule to align the rule with the intent of Congress and to ensure the credit properly incentivizes the entirety of the domestic supply chain for applicable critical minerals and eligible components, including mineral extraction and electric vehicle battery production.

As you know, Congress passed the Inflation Reduction Act (IRA) in part to support the domestic extraction and production of critical minerals and materials, as well as the manufacturing of batteries and their components. Recognizing our increasing foreign dependence on these materials, often from hostile nations, the section 45X credit provides a credit for taxpayers who produce certain critical minerals as well as various energy related products.

We are concerned that Treasury’s proposed rule for the 45X tax credit explicitly excludes direct and indirect material costs for taxpayers seeking to claim the credit. Treasury writes in the proposed rule that “Direct material costs as defined in §1.263A-1(e)(2)(i)(A), or indirect material costs §1.263A-1(e)(3)(ii)(E), and any costs related to the extraction or acquisition of raw materials” are not be included in production costs. The proposed rule goes on to say "…the cost of acquiring the raw material used to produce the electrode active material, the cost of materials used for conversion, purification, or recycling of the raw material, and other material costs related to the production of the electrode active material would not be taken into account.” 

The clear purpose of section 45X was to encourage investment in the United States and to build a reliable and resilient domestic supply chain for critical minerals right here at home.  The section 45X credit was designed to support responsible domestic mining and processing of these minerals. As members of the U.S. Senate we want to clarify that the blanket exclusion of materials costs is not consistent with the intent of Congress and should be expeditiously revised. Section 45X provides for a 10 percent credit for the production costs of applicable critical minerals, and raw materials costs were never intended to be excluded from this calculation. This exclusion is not aligned with the intent of Congress and significantly weakens the tax credit as the cost of extracting raw materials essential for renewable energy, battery technologies, and other critical materials are a significant portion of overall costs.

Additionally, this exclusion weakens the credit’s intended goal to strengthen the New Clean Vehicle Credit, established under Section 30D of the tax code. The 30D credit is designed to counter influence by any “Foreign Entity of Concern” (FEOC) over clean vehicle supply chains. Key to the success of the 30D credit are the 45X credit’s incentives for domestic mineral extraction and processing. A final rule that excludes materials costs will substantially impact critical minerals supply, increasing the challenges for vehicle producers looking to manufacture clean vehicles in the United States.

Private companies are ready and willing to invest in extraction and production of raw materials right here in the United States, and do so in a safe and responsible manner through developed environmental protection and labor standards. However, by excluding the majority of the production costs from the 45X credit, Treasury would disincentivize investment in the United States, and also increase our reliance on countries that do not share our democratic or geopolitical values. This result would be contrary to the intent of the legislation and detrimental to our national and energy security.

We appreciate Treasury’s caution and intent, noted in the proposed rule, to mitigate the risk of double counting and fraud. However, as proposed, the credit eliminates the ability to even single count direct and indirect materials costs and extraction costs, which significantly weakens the credit’s primary purpose of developing a domestic critical mineral supply chain. The risk of double counting production costs can be mitigated using similar basis reduction mechanics and documentation requirements Treasury and IRS require to calculate the value of investment tax credits under sections 48 and 48C. Similarly, IRS is well equipped with the experience and tools necessary to understand and administer the deduction of expenses related to extraction and can apply these to the 45X credit. Additionally, we believe the statute, which directs the credit to be claimed for components “produced by the taxpayer,” provides flexibility for Treasury to establish other safeguards, such as audit and claw back measures, to prevent any type of fraudulent behavior.

Governor Josh Shapiro and Department of Community and Economic Development (DCED) Secretary Rick Siger joined local leaders to highlight the Governor’s proposed investments in Pennsylvania Main Streets, small businesses, and local communities. As part of the 2024-25 budget proposal that focuses on creating economic opportunity for all in communities across Pennsylvania, Governor Shapiro and Secretary Siger visited small businesses on Honesdale’s Main Street business district.

Over the last five years, the Commonwealth has invested $630,000 in Honesdale to improve main street signage, storefronts and infrastructure. During the visit to Honesdale today, Governor Shapiro announced a new $100,000 Keystone Partnership grant to not only continue the work on storefront improvements but also to fund loans for local business owners to afford new equipment, renovation projects, and business marketing.

“Honesdale has such a rich history as a former coal town and the birthplace of the American railroad. Thanks to the strategic investments we’ve made in partnership with local leadership and small business owners, Honesdale’s main street continues to be a thriving place of opportunity,” said Governor Josh Shapiro. “I want to expand our impact on main streets all across Pennsylvania and give more local leaders the chance to realize the full potential of their economies – that’s why I’m calling for major investments to create the Main Street Matters program to invest in the success and prosperity of Pennsylvania small businesses, downtowns, and main streets.”

Governor Shapiro’s proposed Main Street Matters program will be administered through DCED and will build on the existing successes of the current Keystone Communities Program in supporting downtowns, main streets, and surrounding neighborhoods. It will provide for a refresh of the current structure to address a wide variety of needs throughout communities and invest in their revitalization and future prosperity.

“Governor Shapiro’s $25 million investment into the Main Street Matters program will give Pennsylvania communities a much-needed resource to make their main streets better places to live, visit, and work,” said DCED Secretary Rick Siger. “This focus on strong communities and small businesses is especially important today, as Pennsylvania faces more competition than ever as we seek to attract and retain new residents and businesses. It’s time to do more — and the Governor’s call for $25 million for the Main Street Matters program is an investment that our regions deserve.”

During their visit to downtown Honesdale, Governor Shapiro, Secretary Siger, and local leaders met with the owners of custom tailor shop Art’s for Him and Her Too, local boutique Gather, and brewhouse and saloon Runaway Train Brewery.

“Main Street matters because it’s a place for everybody. People live and love here. People work and manage businesses here. People play and dream here,” said Mayor of Honesdale, Derek Williams. “As the seat of county government, commerce, and culture, more folks have a connection to main street and surrounding neighborhoods than will ever technically reside within borough limits. Because of that, we need to support our main street whenever and however we can, it affects a heck of a lot of people. I’m really glad to see main street on the Governor’s list of priorities. I look forward to working with our friends in Harrisburg to make more progress here in Honesdale.”

The announcement builds upon Governor Shapiro’s commitment to create a stronger economy across Pennsylvania. Since day one, Governor Shapiro and his Administration have been working aggressively to make Pennsylvania a leader in innovation and economic development and create economic opportunity for all Pennsylvanians. Last month, Governor Shapiro and Secretary Siger launched the Commonwealth’s first Economic Development Strategy in nearly two decades – building on the Shapiro Administration’s work to make Pennsylvania a leader in innovation and economic development and to create economic opportunity for all Pennsylvanians.

The Governor’s 2024-25 budget calls for significant investments directly tied back to this ten-year strategy and issues a strong call to action for partners across all sectors to join in with their support.

In addition to the $25 million for the Main Street Matters program, other proposed economic development investments in the Governor’s budget include: $500 million in PA SITES funding to bring more commercial and industrial sites to Pennsylvania; $20 million to support large-scale innovation and leverage Pennsylvania’s best-in-class research and development assets; and $3.5 million to create and launch the Pennsylvania Regional Economic Competitiveness Challenge to incentivize regional growth.

Faith Golay comes from the Times-Tribune, and brings over 27 years of experience to this new position. Faith will be responsible for overseeing the day-to-day operations of the news department, as well as digital content production and news publication for WVIA News. She will play a key role in shaping the digital presence and overall voice of the WVIA News Team.
